Understanding Commercial Real Estate Taxation

Navigating property investments requires a clear understanding of tax obligations, specifically the applicable GST rate on commercial property transactions and rental incomes:

  • Under-Construction Properties: Commercial units purchased under construction attract an effective GST rate on commercial property of 12% (18% base rate with a 1/3rd deduction for land value). Developers can pass along benefits using Input Tax Credit (ITC).

  • Completed Properties: Properties sold post-completion with a valid Completion Certificate (CC) carry a 0% GST charge.

  • Commercial Property Rent: Operating or leasing out space incurs GST on commercial property rent at a flat 18%.

  • Applicability & Thresholds: Property owners with an aggregate annual turnover exceeding ₹20 Lakhs must collect 18% GST from tenants. If an unregistered landlord rents to a registered business entity, the tenant must discharge the tax directly under the Reverse Charge Mechanism (RCM).
