NJ solar panel recycling rules face legal review

New Jersey is currently navigating the regulatory implementation of its mandatory solar panel recycling law (S3399/P.L. 2025, c. 211). While the law aims to establish end-of-life accountability for photovoltaic infrastructure, state regulators and industry stakeholders face significant operational and legal challenges prior to full enforcement.

1. Infrastructure Gaps and Regulatory Triggers

  • Limited Recycling Facilities: New Jersey currently has six authorized collection sites for end-of-life solar panels, but only one facility—Commercial Solar Panel Recycling (CSPR)—is actively recycling modules, while others function primarily as transfer stations.

  • Gated Enforcement Date: The law's statutory mandate requiring owners and operators to recycle or refurbish decommissioned panels is gated on a finding by the New Jersey Department of Environmental Protection (NJDEP) confirming that accessible recycling infrastructure exists.

  • Universal Waste Transition: Older solar modules that fail hazardous waste toxicity testing must be managed under strict waste regulations or stored until universal waste guidelines take full effect.

2. Absence of EPR Framework

  • Unique Legislative Model: Unlike states like Washington, New Jersey passed its mandatory recycling law without an Extended Producer Responsibility (EPR) structure, leaving questions around long-term financing and system management.

  • Refurbishment Alternative: The law explicitly allows panel refurbishment and resale alongside recycling, enabling functional panels removed during roof upgrades to re-enter the market rather than being processed as waste.

3. Industry Outlook and Compliance

State regulators are analyzing national models to ensure compliance rules do not stifle solar deployment or prompt manufacturer exits. In the interim, commercial solar operators are increasingly leaning on voluntary recycling to mitigate potential reputational risks and ensure long-term sustainability alignment.
